The following Terms and Conditions, as well as our Privacy Policy, relate to and govern your use of My BMW (“App”) and your relationship with the application owner BMW Hong Kong Services Ltd. (“BMW”, a limited liability company incorporated under the laws of Hong Kong, whose address is at Room 2810, 28F, China Resources Building, 26 Harbour Rd., Wan Chai, Hong Kong) and its subsidiaries. By using this App, you agree to abide by the following Terms and Conditions.
1. Functional scope and availability of the App
My BMW is a personal mobile application that integrates BMW vehicle connected driving features, travel management, and more other features into one application. For detailed information on the services included in the App, please see below.
In order to use all the services and features of the App more effectively, the mobile device using the App and the BMW vehicle App must have the mobile network function and operating status required by the built-in SIM card. In some cases, the App and its services and features may be geographically limited by reception and the service range of the network provider, and particularly may be affected by atmospheric conditions, topographical features, mobile devices and/or vehicle positions, and obstacles (such as bridges and buildings).
The services of the App may be disrupted by force majeure factors, such as strikes, lockouts, and public authorities orders, as well as technical and other works (e.g., maintenance, repair, system software updates, expansion) required to be carried out on the systems of BMW, traffic data providers, or network operators for the proper operation or improvement of the services. In addition, the application services may also be disrupted by temporary lower performance due to overload requests of the App services or by failures in the vendors’ telecommunication systems. BMW shall make every reasonable effort to rectify such failures or assist in carrying out repairs.
If the services are interrupted, you may notify the BMW customer support department via email or phone. For detailed contact information, please refer to the “Contact Information” section of this document.
The BMW Connected service is a family of applications and services. The service includes BMW Connected and My BMW App for iOS, BMW Connected and My BMW App for Android, MINI Connected and MINI App for iOS, MINI Connected and MINI App for Android, BMW Connected applications running in the vehicle.
The following features are included in the BMW Connected service. The actual features available to you may vary depending on the technical capabilities / equipment of your vehicle, your country of residence and the device you use to access the service. Features and services that are available only in BMW or MINI are indicated below. All other features are available in both BMW and MINI.

My ConnectedDrive Account
Your BMW Connected account is the key to unlocking a world of Connected services. Your account ties your vehicle, preferences, and data all to your profile so that the service becomes your personalized mobility assistant.
Account Creation/Cancellation and Login
By its nature, the Connected service is intended to provide you with a highly personalized experience. In order to personalize the service specifically to your preferences and travel patterns, you will need to create your BMW account or log in unless you already have one.
You may already have an account if you use other BMW services that require you to login. A ConnectedDrive account may have been created when you purchased your vehicle. If it was created for you, it should be used to log into the Connected service. Your user ID will be included in the paperwork you received with the vehicle.
How to create and edit, cancel your account
If needed, you can register your account in the App. In the App, select the option “Register here” on the login screen. In the profile, you can apply your account cancellation request.
Logging in and access PIN
When you log into the App for the first time, you will be prompted to create a PIN and optionally enable Touch ID/Face ID (on later model iOS devices). The App stays logged in until you manually logout. To keep your data secure, when you open the App, you will be prompted to authenticate using the PIN, your Touch ID or Face ID (on later model iOS devices).
Profile Picture
Using the App, you can set up a custom profile image. You can choose from a set of default avatars, or you can upload a photo from your phone.

Your BMW login is shared across BMW Group legal entities so that the relevant entity could provide services to you.
When will data processed be deleted?
Your Connected account data will be retained as long as you continue to use the Connected service. If you stop using the service for more than 5 (five) years, the service is unlinked from your BMW account and all application data will be deleted. Your BMW account is not deleted since you may still use it with other BMW services. Your BMW account can be deleted by contacting BMW with a request for erasure. See section in the Privacy Policy on “Your data privacy rights” for instructions.
Login Mapping Merge
A vehicle owner (inviter) can search the invitee by inputting the phone number and confirm to start the invitation. The phone number of the invitee must be registered number in BMW ID. The invitee will get the invitation in the App and decide whether to agree to the invitation. If the inviter / invitee input his/her name, it will be shown in the App, and s/he may modify such name data in the App. If no name data is input, the App will only show the harsh phone number, e.g. “852****8888”. The vehicle owner can send 10 invitations per day. The invitation will be expired in 7 days if the invitee does not accept the invitation. The vehicle owner can withdraw the invitation before it is accepted by the invitee. If the invitee accepts the invitation, s/he will become a co-user. The vehicle owner can delete a co-user in the App. A co-user can only delete him/herself in the App.

Your data and the Open Mobility Cloud
Most data collected and processed by the service is stored in the Open Mobility Cloud (OMC). The OMC is hosted in Microsoft Azure data centers in the PRC. Data is processed in the PRC.
BMW ensures that your personal data is processed in accordance with local privacy regulations, including the Personal Data (Privacy) Ordinance and relevant guidelines, including suitable technical and organizational measures. All other data processed by the service is hosted on BMW IT systems.
Technical logs are generated to enable system administrators to monitor and troubleshoot the system. Logs are retained for 30 (thirty) days.
Your Permissions Settings
The service will ask for your permission to collect or share your data in several ways.
Data collection and processing by the service
- Your permission may be needed for a single transmission, such as submitting your data to set up a service appointment for your vehicle.
- When you use the App for the first time, you will be prompted for permission to collect and process a few specific types of data (see below list). If you decline, the features that require this data will be disabled.
- By agreeing to the Privacy Policy, you are giving your consent for the service to collect and process all other data types.
Consent is requested for the following specific types of data:
- notifications (all notifications on/off) and options for some specific notice types
- photos (Customer avatar)
- camera (Customer avatar)
You can change your permissions at any time from the “Settings” Menu in the App.
Notifications and In-App Messages
Many of the App features push notifications that are displayed on the lock screen of your Smartphone. Other features display messages and information on the “Activity” tab in the App itself.
Notice Messages

- feature notices, such as time to leave and weather alerts
- vehicle status, such as recall alerts and your vehicle is due for an oil change
- service expirations, such as your ConnectedDrive real time traffic service is about to expire
- general application notices, such as what is new in this version of the App
Offer Messages

You can enable/disable the application notifications by changing the notification permissions in the "Settings". In addition, you can enable/disable offer messages at any time on the "Settings" | "Notifications" screen. BMW engages Getui (個推) to provide push notification services to the App. By enabling the application notification and/or offer messages feature, you agree to the privacy policy of Getui (個推): https://docs.getui.com/privacy/.

Message Center
The user could check the history message in the message center. There are three different types of messages: new message, unread message and read message.

Analytics
For the purposes of product improvement, we gather pseudo-anonymous analytic data (which cannot be used to identify any particular individual) on App and feature usage. This information is sent along with a unique ID that is created when you first use the App. The data is aggregated together with data from all users. In addition, anonymized location data is used to create a visual representation of user distribution across the world. The insights from this data support our product development efforts by helping us to detect and fix bugs, and to identify opportunities for new features.
Your Vehicle Identification Number (VIN) may be used in the efforts to improve product features such as adding your vehicle to the App and performing remote services commands. All results from the analysis are aggregated with data from all users therefore becoming anonymized statistics – individual data is not reviewed. In addition, if you report a problem via the App’s “Send Feedback” page, your VIN may be used to help us identify and fix the issue.

User Feedback
At any time, you can share your ideas or issues regarding the Connected service with our Product team. You will also occasionally be prompted in the App to rate your experience and leave comments. All feedback opportunities are optional.
The feedback comments are intended to be anonymous. However, if you enter personal information in the free-text comment box, this information will be shared with and transferred to the Product team.

iOS / Android widget
You can add MY BMW widget to the main phone screen for quick checking the remote car services. By clicking the widget, you can directly turn to corresponding services in MY BMW.

My Destinations
Mobility is all about getting where you want to go on time. The Connected service makes finding and navigating to your destinations effortless.
Whether you search or manually add a destination to the App, the App displays details such as the name of the location and street address.
Adding a destination
Find and add destinations to the Connected service manually by typing them in, by copying or sharing an address from another App, or by pressing and holding on the map to drop a destination pin. You can then view the details of a destination, such as the exact address, its distance from your current location, and your estimated travel time.

- Destination features, such as calculating your travel time, require the location permission setting to be enabled.

When you search for a destination, whether you are searching manually or by category, your search request is sent to the service map provider in order to find and display your search results.
Connected Service use center location of map to conduct destination search, which is by default from your vehicle position or mobile device location from your phone, so that the search results are optimized to include destinations near your current position. You can also manually move the map to choose target center location for destination search.
Search
- Search text or category.
- Search History: Unless you delete the destination history list, the search history will be stored in your local device.
- Favorites: You can add your favorite points of interest to favorites in My BMW HK App.(stored in your local device)
- Parking Nearby: When you start guiding to a destination an online POI search is triggered around the destination to check if there are parking lots close by
- Charging nearby: When you start guiding to a destination an online POI search is triggered around the destination to check if there are charging stations close by
- Map Center Location
Navigating to My Destinations
You can send the destination from the App to your vehicle’s navigation system over the air – no USB or Bluetooth required.

The destination will be sent to the vehicle you have selected in the App. The data is sent over secure communications channels (SSL) via a BMW IT system.

The Map
The App displays your destination and search results on a map, along with center location of Map. Maps are provided by "Tencent". Center location of map is by default from your vehicle position or mobile device location from your phone, so that the search results are optimized to include destinations near your current position. You can also manually move the map to choose target center location for destination search.

The service sends map center location (latitude/longitude coordinates) to the map provider to request the map image displayed in the App. No personally identifiable information is included with your location.
Tencent Map
Tencent is providing the map and online content for the App. In order to provide online map content, center location of map is directly transferred to Tencent. All data processing by Tencent is conducted in an anonymous manner in accordance with Tencent’s Privacy Policy. Reachable POIs
The feature shows an indication for BEV vehicle, if a POI is in range or not in range compared with the current State of Charge (SOC) of the currently active BEV in the App.

- The feature needs to know the distance to the destination (from Tencent which is the same content provider with other map related features) to calculate if a destination is reachable with vehicle's current electric range.

Learning Navigation
Learning Navigation makes commute easier for you by learning your commute patterns and will notify you what time to leave, and the traffic condition based on predicted trip data.

- Head unit is ID8 or ID9.

Data transmitted to 3rd parties:
The service sends hashed VIN, encrypted GCID, seating occupancy, door status, start position, current positions, onboard home and onboard work to the navigation solution provider to learn the commute patterns and provide predictions so we can send notifications to you accordingly. No personally identifiable information is included in this information.
Tencent and Navinfo
Tencent (for ID9) or Navinfo (for ID8) provides the navigation solution to this function. All data processing by Tencent or Navinfo is conducted in an anonymous manner in accordance with their respective privacy policy. By accepting these terms, you also accept their respective privacy policy. Tencent’s privacy policy can be found at https://map.wap.qq.com/vision/privacyv2-care-tmap/index.html,

When will data processed be deleted?
- Raw data are usually kept 14 days in the BMW IT system and will be automatically deleted at the service provider after maximum of 30 days.
- Processed data (learned data) will be stored for 14 months. After 14 months they will be deleted automatically by the navigation solution provider.
- Costumers may request to have their data deleted by BMW and/or the learning solution provider at any time.
Dark Mode
More and more people tend to set the mobile system or App theme to dark mode, a way to enhance night use and protect eyesight. The consistency between App appearance and mobile system setting will also enhance the continuity between the App and the system. User can switch on Dark Mode in My BMW HK App; after it’s switched on, My BMW App appearance will follow the system setting to switch on or off Dark Mode and therefore optimize user experience.
Prerequisites:
- Smartphone downloaded with My BMW HK App supporting Dark Mode function.
How to use:
- Open My BMW HK App, log into your account and enter Profile tab. By default, Dark Mode is switched off, and My BMW HK App appearance is light.
- Tap to switch on Dark Mode, and My BMW HK App appearance will follow the system setting to switch on or off Dark Mode.
- Tap to switch off Dark Mode, and My BMW HK App appearance will not follow the system setting and be set as light by default.
What data will be processed or stored on the Smartphone:
No data is processed or stored on the Smartphone.
After Dark Mode is switched on, My BMW HK App only obtains the dark mode setting of the mobile system (non-personal data).
Except for the system dark mode setting, My BMW HK App will not obtain, process or store any other data relevant or irrelevant to personal privacy.

Digital Key
Why take your key with you if you have your smartphone with you? You can lock and unlock your BMW and even start it with the Digital Key. For the short distance (less than 6 meters), you can use the Automatic Doors and Easy Entry (level control) via Bluetooth. You can also authorize up to five people with compatible smartphones to use your BMW. Among other things, drive power and maximum speed can be limited, e.g., for novice drivers.
Prerequisites:
- Compatible vehicle with the option Comfort Access (SA 322)
- SA 6AE
- BMW Digital Key Plus is compatible with iPhone 11 and above and Apple Watch Series 6 and above models equipped with Apple U1 chip, and smartphones and watch equipment systems need to be upgraded to iOS 15 and Watch OS 7 and above
- Automatic Doors could only use for G70 vehicles with SA3CD head unit version of 0323 and above.
- Easy Entry (level control) could only use for G07 vehicles with SA2VR head unit version of 1122 and above.
When is BMW Digital Key service available?
- By purchasing the option SA 322 Comfort Access the buyer purchases the vehicle-side enablement of the BMW Digital Key for listed compatible smartphones with supported operating system.
- The list of compatible devices and supported operating systems for the various BMW vehicle models can be found on the BMW website.
- You may run into a situation where the Digital Key service cannot be used. This may be due to reasons out of the control of BMW such as:
- BMW puts major effort into the security and privacy of the Digital Key service by using state-of the art encryption methods and other measurements. At the time of purchase of your BMW vehicle these security measurements are state-of the art and no significant attacks are known. Should a 3rd party be able to successfully attack one of the used common security and encryption methods, BMW will investigate its potential harm to you and/ or your vehicle. BMW reserves the right to terminate the Digital Key service with immediate effect in this situation in order to reduce the risk of harm to you and/or your vehicle.
- Should newer smartphone models or changes to the general way the Digital Key standard works require a software update for your vehicle in the future, BMW reserves the right to offer a paid software upgrade.
How-to activate:
For first time use of BMW Digital Key, an online connection of your vehicle and smartphone is necessary. For use of the service after activation, no online connection is required.
The vehicle owner is responsible that the BMW Digital Key is not misused by a 3rd party person. In order to help prevent this, for initial setup, two classic key fobs are required from inside of your vehicle.
Setup
The following data is used to provide service:
- VIN: Vehicle Identification Number
- GCID: Global Customer ID, Identification method for the vehicle owner

- VIN, to ensure the service is available for a given vehicle.
- GCID, creation of the main key is only available for the vehicle owner

- Vehicle Signature Private Key

When will data processed be deleted?
During use of BMW Digital Key the mentioned data above is saved in a secure BMW backend, namely by BCS in PRC (please refer to the Privacy Policy) or in the vehicle for your vehicle. This way, BMW can ensure that the BMW Digital Key service is usable for you.
Keys can be deleted:
- On the smartphone of the vehicle owner (main key + friend key(s))
- On the smartphone of the friend (only their own friend key)
- In the vehicle
To delete the main key from the vehicle, a classic key fob has to be present inside the vehicle. To delete a friend key from the vehicle, a classic key fob or the main key has to be present inside the vehicle. Anybody with access to the vehicle via a classic key fob can delete digital keys.
After deletion of key(s), information related to your key are saved such period no longer than permitted by applicable law in a secure BMW backend, namely by BCS in PRC (please refer to the Privacy Policy). In case of theft of your vehicle, BMW could – only with your explicit approval – list active keys at the time of theft in order to help solve the case. Alternatively you may request us to delete these information earlier by contacting us. For detailed contact information, please refer to the “Contact Information” section of this document.
All keys will be deleted if you request BMW to delete your personal data. You may request deletion of your personal data by contacting BMW (please refer to “Your data privacy rights” section in the Privacy Policy).
Dealers and Service
Features related to finding a BMW Service Center and servicing your vehicle.
Depending on the local requirements in each market, the service details may differ.
Roadside Assistance
Need help on the road? You can call Roadside Assistance directly from the App. In some countries, you can choose to share your GPS location with BMW’s external Roadside Assistance Agent directly from the App when you call. If you choose to share your GPS location, you will be able to track the location of the service vehicle as it navigates to your location. If you choose not to share your location, you will need to describe your location to the Roadside Assistance Agent. The external Roadside Assistance Agent varies depending on the country.

Remote 360 / 3D
The feature provides an opportunity to assess the situation around parked vehicle. Users may make request from the App so that the four surround view cameras of the vehicle will take photos, which will be transferred encrypted to the requesting smartphone via mobile network and shown as a composed 3D image. In the composed image, the 3D panoramic view around the vehicle is displayed. Only the ConnectedDrive account holder of the vehicle (mapped vehicle in ConnectedDrive portal) can request and watch the 3D image.
When using the Remote 360 /
3D function, users may still use other functions in the App. A user may use the function at most 3 times during every 2 hours. Vehicle number plates and individual faces in the
photos taken will be blurred.

Remote interior camera (the vehicle shall be equipped with interior camera)
-The “Remote interior camera” function allows sending pictures taken by interior camera of the vehicle to My BMW App on your CE device.
- The BMW ConnectedDrive backend does not store any photos or videos processed; they will be forwarded directly from the vehicle to your CE device.
- You can use this function only if you are connected via My BMW App with the vehicle. Therefore, your vehicle must be mapped inside the corresponding connected Drive.
- This function is only allowed if the engine is turned off. If the vehicle is in motion or the engine is turned on, the function is automatically blocked and not useable
- This function is deactivated by default in the data privacy menu of the vehicle. You must actively activate the function for the corresponding profile inside the vehicle.
- You may deactivate the function inside the data privacy menu.

Vehicle anti-theft alarm system (the vehicle shall be equipped with interior camera)
-The “vehicle anti-theft alarm system” function allows sending pictures taken by interior camera of the vehicle to My BMW App. It informs you about a potential theft or towing of your vehicle triggered by the vehicle’s anti-theft alarm system.
- The BMW ConnectedDrive backend does not store any photos, and the photos will be forwarded directly from the vehicle to your App.
- You can use this function only if you are connected via My BMW App with the vehicle. Therefore, your vehicle must be mapped inside the corresponding connected Drive Account.
- This function is only allowed if the engine is turned off. If the vehicle is in motion or the engine is turned on, the function is automatically blocked and not useable.
- If this function is activated, you will be informed of the activation of this function by the My BMW App which also offers a list of available recordings for you to view.
- This function is deactivated by default in the data privacy menu of the vehicle. You must actively activate the function for the corresponding profile inside the vehicle.
- You may deactivate the function inside the data privacy menu in the vehicle.

First Time Use
For the vehicles with ID9 head unit, there is only one way to login to vehicle, i.e., scanning QR code on vehicle via the App. Your profile will be thereby sent to the vehicle and the login will be done automatically.

Charging History
You can use My BMW App to check detailed display of an ongoing charging session including current and target state of charge and range, used charging settings and estimated time when charging will be finished.
You can use My BMW App to set up preferred charging mode. set up several departure timers and remotely control preferred charging settings, depending on your vehicle capabilities.
Charging Profile
Under the Charging Plan module, you can access charging profile and adjust setting such as charging Start/End time and charging target (%) according to your preference.
Charging Notifications
You can receive notifications about specific charging events during active charging processes.
Charging Plan – Remote Charging Commands
You can use Remote Charging Commands to stop charging, restart charging or unlock charging cable from your smartphone.

- The retention time for remote services events is 30 days. After that time events are automatically deleted from the database and can no longer be accessed by any client.
- As long as the charging history feature is activated no data is deleted. After deactivation or de-mapping of the vehicle the retention period is 90 days.
- When user requests to delete account.
2. App modification and termination
BMW reserves the right to modify the functional scope of the App, and you will be notified accordingly through the App.
You may delete the App from your personal mobile device to terminate the use of the application. BMW reserves the right at its sole discretion to stop providing App services at any time with six weeks’ notice; however, no notice will be provided in case of breach of these terms and conditions or misuse or illegal use of the App.
3. BMW account
To use the App, you are requested to create a BMW account with local BMW authorized dealer.
To use the remote functions in the App, you must add your vehicle through the BMW authorized dealer.
4. Data charges
The App needs to use the wireless or mobile data access function of the mobile device. You are responsible for the necessary information to ensure the use of the services. Providers that access mobile devices may collect data access charges related to the use of the App. All such charges paid to partner network providers shall be borne by yourself.
5. Privacy policy
By using this App, you agree to our Privacy Policy, the details of which can be viewed in the App settings. The Privacy Policy forms an integral part of these terms.
6. GPS and estimated time of arrival
The App uses GPS to calculate the approximate destination arrival time. Please note that running GPS in the background continuously may significantly consume the battery charge of your mobile device. Depending on the mobile service provider and service plan, standard data transfer speed may be used. Arrival times are only estimated as many factors may affect the actual arrival time, such as traffic and weather.
7. Do Not Use during driving
You are reminded to use the App only under safe conditions when operating the vehicle. Unless the App is already connected to the infotainment system display and can be used hands-free in a manner that does not distract operation of the vehicle, please do not use the App while driving a vehicle.
8. Liability
BMW does not assume any liability for the accuracy and topicality of the data and information transmitted via the App. BMW also does not assume any liability for consequences of disturbances, interruptions, and functional impairments of the App.
TO THE EXTENT PERMITTED BY APPLICABLE LAWS, BMW AND ANY OF ITS LEGAL REPRESENTATIVES, AGENTS, AND EMPLOYEES (COLLECTIVELY “BMW PERSONS’) DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BMW Persons shall only be responsible for foreseeable loss and damage directly caused by its breach of these Terms and Conditions and any applicable common law duties, and shall not be responsible any loss of profit, loss of business, business interruption, or loss of business opportunity.
The App and the services and functions available on the App are provided for general information and entertainment purposes only. They do not offer advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of information obtained from the App or the services and functions available on the App.
The liability of BMW remains unaffected in the event of any malicious concealment of a fault, on account of accepted guarantee or procurement risk, and in accordance with product liability legislation. Limitations of liability do not apply to intentional act, gross negligence, or death, physical injuries, and damage to health.
The App is INTENDED for use in Hong Kong SAR. To the extent permitted by applicable laws, (a) BMW persons disclaim all representations and warranties in relation to the use of the App outside Hong Kong, whether express or implied, including any representation or warranty of merchantability, fitness for a particular purpose, title, non-infringement, and compliance with laws; and (b) BMW shall not be liable for any direct or indirect loss or damage whatsoever arising from, caused by or in connection with use of the APP outside Hong Kong. You agree continuously to indemnify and hold BMW (and any of its employees, officers, directors, agents, or service providers, as applicable) harmless against any demands, loss, damage, liability, claims or expenses (including legal costs) made against the aforementioned persons by any third party due to or arising out of or in connection with your use of the APP outside Hong Kong.
9. Vendors’ services
Any links or features contained in this App for accessing vendors’ programs or content are provided for convenience only. BMW does not express any opinion on, endorse nor support the content of any such vendors’ programs, and clearly states that it does not bear any responsibility for the quality, content, nature, or reliability of all such vendors’ resources and the information, products, and services contained therein.
10. Use of the App
You must not use the App for illegal purposes or permit vendors to do so. You are not entitled to distribute or process commercially the data and information received when using the App. BMW shall have the sole right to determine which uses of the App are improper and/or unauthorized. For unauthorized uses of the App, BMW may take any appropriate countermeasures, including, but not limited to, stopping your use of the App.
11. Copyright and trademark
Unless otherwise specified or required under applicable laws, BMW owns the copyright to all data and information contained in this App. This App and all of its data and information are for reference only and are subject to all applicable laws of Hong Kong and Macau SARs, PRC, and international copyright laws. Reproduction or transmission in any form or other uses are strictly prohibited, unless permitted by law. In particular, you may not use any data in the App for commercial purposes without BMW’s prior written permission.
BMW is the owner of the contents of this App or is licensed to use all intellectual property, and BMW reserves the right to pursue any intellectual property infringement. You are not authorized to use any trademarks of BMW.
12. Other matters
12.1 Applicable law and jurisdiction: These terms shall be governed by and construed in accordance with the laws of the Hong Kong SAR and you hereby irrevocably submit to the non-exclusive jurisdiction of the Hong Kong courts in relation to any proceeding arising out of or in connection with these Terms or the App.
12.2 Compliance: BMW makes no warranty that the App is appropriate or available for use in places other than Hong Kong. When using this App in other regions, comply with the local laws. When downloading the App, you warrant that you are not located in any country, or exporting such software to any person or region, to which Hong Kong has embargoed goods.
You represent and warrant that you have attained the legal driving age and you will not breach any applicable laws by using the App. Your further represent and warrant that any 3rd parties authorized by you to use your BMW vehicle (whether by way of BMW Digital Key or otherwise) have attained the legal driving age and will not breach any applicable laws by driving your BMW vehicle or using the App.
12.3 Void where prohibited: Although this App and its contents are accessible worldwide, any products or services provided in regions where prohibited by law are void. Accessing the App in regions where its contents are illegal or against the law is prohibited.
12.4 Changes to Terms and Conditions: The current version of these Terms and Conditions may be viewed in the settings of the App. BMW has the right to change these Terms and Conditions at any time. We will notify you of the changes by publishing the revised Terms and Conditions on this page, as well as alert you when you open the App. BMW recommends that you review these Terms and Conditions regularly for any changes. Certain Terms and Conditions may be superseded by expressly designated legal notices or correspondence sent to you. Continued use of the App after notification of any change in the Terms and Conditions (whether or not received or acknowledged) indicates you consent to such change. The date on which this policy was last revised is at the top of this page.
12.5 Severability: If any provisions in the Terms and Conditions are determined to be illegal, invalid, or unenforceable, they shall be terminated and deleted to the extent that the Terms or Conditions are illegal, invalid, or unenforceable. The remaining Terms and Conditions will continue to be used and remain in full force and effect, as well as continue to be binding and enforceable. No waiver by BMW of breach of an obligation arising under these Terms and Conditions shall constitute a waiver of any other breach.
